Introduction

Welcome to Garden.com.bd, a marketplace platform connecting buyers and independent merchants. By using our website, you agree to abide by the following terms and conditions. If you do not agree with these terms, please refrain from using our platform. These terms govern your access to and use of Garden.com.bd, including all content, features, and services provided.

1. Account Registration

Users may browse the platform without an account, but purchasing requires registration.
You must provide accurate, complete, and up-to-date information during registration.
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
Users must be at least 18 years old to register an account. We reserve the right to suspend or terminate accounts with false or incomplete information.

2. Orders & Payments

Garden.com.bd collects 100% upfront payment for all orders.
Payments are processed securely through bKash payment gateway.
Orders are confirmed only after full payment is received.
All transactions are processed in Bangladeshi Taka (BDT). Additional fees, such as taxes or shipping charges, may apply and will be displayed during checkout.

3. Merchant Responsibilities

Merchants are solely responsible for listing accurate product descriptions, images, and pricing.
Merchants must fulfill orders within the promised delivery time frame and ensure product quality, packaging, and timely shipping.
Merchants must comply with all applicable laws and regulations, including consumer protection and product safety laws.
Failure to meet these responsibilities may result in penalties, account suspension, or termination.

4. Delivery & Shipping

Orders are delivered directly by merchants. Estimated delivery times are provided by merchants and may vary.
Garden.com.bd is not responsible for delays, delivery failures, or damages caused by merchants or shipping carriers.
If a user buys from multiple sellers, product deliveries will be separate and may arrive at different times.
Users will receive tracking information for their orders, where available. The risk of loss or damage to products passes to the buyer upon delivery to the shipping carrier.

5. Returns, Refunds & Cancellations

Refund and return policies are defined by Garden.com.bd. Users and merchants must adhere to these policies.
Users must contact merchants via the platform's built-in messaging system for product inquiries, delayed deliveries, non-deliveries, or damaged products.
If users fail to get a resolution from the merchant, they may request a refund from Garden.com.bd, which will be processed at the platform's discretion within 10-15 business days.
Products must be returned in their original packaging and unused condition. Return shipping costs will be borne by the user unless the product is defective or incorrect.
Cancellations are subject to communication with the merchant. If the merchant has not shipped the product, the user may request a cancellation. Cancellation requests are applicable only after the user has placed an order and made the payment.

6. Liability & Disclaimers

Garden.com.bd is a platform connecting buyers and merchants and does not directly sell or manufacture products.
We are not liable for product defects, damages, or losses caused by merchants or shipping carriers.
Users purchase products at their own discretion and risk.
We are not liable for delays or failures caused by events beyond our control, such as natural disasters, government restrictions, or unforeseen and uncontrollable events. Our liability is limited to the total amount paid by the user for the affected order.

7. Prohibited Activities

Misuse of the platform, including fraudulent orders, fake reviews, or data scraping, is strictly prohibited.
Merchants must not list counterfeit, illegal, or restricted products.
Users or merchants must not attempt to manipulate pricing, disrupt marketplace operations, or engage in harassment or illegal activities.
Violations may result in account suspension, termination, or legal action.

8. Intellectual Property

All content on Garden.com.bd, including logos, text, and images, is protected by copyright and intellectual property laws.
Users and merchants must not copy, distribute, or reproduce any content without prior written permission.
By posting content on the platform, users/merchants grant Garden.com.bd a non-exclusive, royalty-free license to use, display, and distribute the content.

9. Amendments & Modifications

Garden.com.bd reserves the right to modify these terms at any time. Users will be notified of changes via email or a notice on the platform.
Continued use of the platform after modifications constitutes acceptance of the updated terms.
It is the user's responsibility to review the terms periodically for updates.

10. Governing Law

These terms are governed by the laws of Bangladesh.
Any disputes arising from these terms shall first be resolved through negotiation or mediation. If unresolved, disputes shall be brought to the appropriate courts of Bangladesh.

11. Product Reviews

Ratings and reviews are made by users and reflect their personal opinions.
The platform does not hold any liability for positive or negative reviews.
Reviews must be based on genuine user experiences and should not contain false, misleading, or defamatory information.
The platform reserves the right to moderate, remove, or hide reviews that violate community guidelines, contain inappropriate content, or are deemed spam.
Merchants cannot manipulate or incentivize reviews in exchange for benefits.
Users should refrain from using offensive language, hate speech, or defamatory content in reviews.

12. Termination

Garden.com.bd reserves the right to terminate or suspend users/merchants accounts that violate these terms, engage in fraudulent activities, or misuse the platform.
Users may terminate their accounts at any time by using their dashboard.
